Elbert County zoning compliance is not HOA enforcement

A rule can be real and binding and still not be something the county will touch. That surprises people who assume one office handles every neighborhood dispute on the Eastern Plains.

Elbert County’s zoning compliance work enforces the Elbert County Zoning Regulations. It does not reach HOA rules or neighborhood covenants, because those are private agreements between property owners and their associations, not public land-use law.

The gap shows up most in rural subdivisions and small-acreage neighborhoods, where covenants and zoning can point in different directions. A covenant might limit the color of a barn or the number of outbuildings; zoning governs uses, setbacks, and permits. When the two disagree, the county is not the referee, and it has no power to make a neighbor follow a private covenant.

So the move is to figure out which kind of rule you are dealing with before you act on it, because the right office depends entirely on the answer. A zoning or land-use problem belongs with Elbert County. A covenant problem belongs with the HOA, the recorded covenant documents, your title work, or a private attorney who can read the agreement and tell you what it actually requires. Buying a property on the belief that “the county will make them fix it” can leave you holding a dispute the county was never going to enter.
